These Terms and Conditions (“Terms”) govern your access to and use of SpryLearning (“Spry”, the “Service”), including our website and our tablet apps for iPad and Android. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of a child, family, class, or school, you confirm you have authority to do so. Spry is a supplementary primary-years learning platform aligned to the Australian Curriculum (V9) for Foundation (Prep)–Year 6; it is not a substitute for a school or a complete curriculum, and we do not guarantee specific educational outcomes.
Because Spry is used by different people, these Terms include role-specific sections for parents and guardians, children and learners, teachers, and school administrators and coordinators. If a role-specific section conflicts with a general section, the role-specific section applies to that role.
Accounts and eligibility
- Accounts must be created and managed by an adult — a parent, guardian, teacher, coordinator, or school administrator.
- Children do not create their own accounts; they use supervised child / student profiles created by an adult.
- You must provide accurate information, keep your login credentials secure, and you are responsible for all activity under your account, including the profiles you create and supervise.
- We support sign-in by email and password and by Google; you are responsible for the security of any third-party login you use.
- Notify us promptly at help@sprylearning.com.au if you believe your account has been compromised.
The Service and roles
The Service includes a parent/child experience (child profiles, baselines, the kids dashboard, the knowledge map, quizzes, videos, reading, and rewards) and teacher/school tooling (class rosters, per-topic class status, and assistant-teacher access). Available features depend on your role (parent, teacher, coordinator, administrator) and on whether you have an active subscription or school arrangement. We may add, change, or remove features over time, and some features may be in development and not available in every release or on every device.
Subscriptions, billing, and free tier
- The learner experience includes a free tier (for example, the first Mathematics topics). A paid Spry All Access subscription unlocks the full breadth of content across all learning areas and year levels, and covers up to 6 child profiles per adult.
- Subscriptions purchased through the Apple App Store or Google Play are billed by the relevant app store under its terms. Payment is charged to your store account at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel renewals in your app store account settings; cancelling stops future renewals and you keep access until the end of the current billing period.
- Except where required by law or store policy, payments are non-refundable. Store refunds are handled by Apple or Google according to their policies.
- Prices, plans, and the boundaries of the free tier may change; we will not change the price of an active paid period you have already been charged for.
- Schools may be offered separate licensing or invoicing arrangements that do not use app-store billing; these are governed by a written agreement.
Acceptable use
You agree not to:
- Use the Service in any unlawful way, or to infringe the rights of others.
- Attempt to access accounts, data, classes, or systems you are not authorised to access.
- Add children, students, or guardian contacts without the authority and any consents required to do so.
- Upload content that is unlawful, harmful, deceptive, or inappropriate for a child-focused platform.
- Interfere with, disrupt, probe, overload, or reverse engineer the Service, except where that restriction is prohibited by law.
- Resell, sublicense, rent, or commercially exploit the Service without our written permission.
- Use the Service to build a competing product or to scrape content or data.
Content, data, and intellectual property
The Service — including its software, learning content, questions, artwork, characters, themes, and branding — is owned by SpryLearning or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, family, or authorised educational use, in line with these Terms and your role. Curriculum frameworks and any third-party reference data (for example, public school-directory or library-catalogue data) remain the property of their respective owners, and embedded third-party content is subject to the third party’s own terms. Progress and profile data created through your account remain associated with your account (or, for school-managed students, with the school).
Parents and guardians
- You confirm you are the parent or legal guardian of, or are otherwise authorised to supervise, each child profile you create.
- You are responsible for the child profiles under your account, what is entered in them, and your children’s use of the Service. Please use a first name or nickname rather than a full legal name where possible.
- You manage your subscription through your app store account; your subscription unlocks content for up to 6 child profiles per adult.
- If a teacher invited you by listing your email as a guardian on a class roster, signing up may link your account to your child’s school record. Contact us to ask about that link.
- You may delete your account and your children’s profiles at any time — see our data deletion page.
Children and learners
- Children use the Service only through a supervised profile created and overseen by a parent, guardian, teacher, or school.
- Children cannot make purchases, change billing, or create their own accounts.
- The supervising adult is responsible for the child’s use of the Service and for deciding what is appropriate for that child.
- We design the children’s experience to be free of third-party advertising and to avoid selling children’s data — see our Privacy Policy.
Teachers
- You confirm you are an educator authorised by your school to use the Service for your class, and that you have the authority and any consents required by your school before adding student records or guardian email addresses.
- Student records, class rosters, and per-topic class status that you create are used to operate your class and to link guardians who later sign up. They are processed on behalf of your school.
- You may invite assistant teachers, limited to colleagues at the same organisation; you are responsible for who you invite and for ensuring their access is appropriate.
- You must use class and student information only for legitimate educational purposes, and must not export, share, or retain it in breach of your school’s policies or applicable law.
- Free or trial teacher access (where offered) does not by itself grant a paid family entitlement to students or guardians.
School administrators and coordinators
- A school or coordinator that adopts Spry is responsible for authorising its staff, for the lawful basis for any student information loaded by its teachers, and for compliance with its own privacy, child-safety, and procurement obligations.
- Where the Service is provided to a school under a separate written agreement (for licensing, invoicing, data processing, security, retention, or seat counts), that agreement governs to the extent it conflicts with these Terms for that school’s use.
- Coordinators with school-level access (where enabled) may view class and progress information within their school’s scope only.
- Spry maintains a reference directory of Australian schools (from public ACARA / My School-style data) to support school selection at sign-up; this does not imply any endorsement by, or relationship with, a listed school absent an agreement.
- On termination of a school arrangement, we will, on request and subject to legal retention requirements, return or delete student information processed on the school’s behalf.

Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or suitable for a particular student; Spry is a supplementary tool and does not guarantee specific educational outcomes. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other mandatory consumer protections that cannot lawfully be excluded. Where our liability for a failure to comply with such a guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of re-supply.
Limitation of liability
To the extent permitted by law, and subject to the disclaimers above, SpryLearning is not liable for indirect, incidental, special, or consequential losses, or for loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the liability (or, where the Service was provided free, to AUD 100).
Termination and deletion
You may stop using the Service and delete your account at any time from within the app or by email (see our data deletion page). Deletion removes your profile and the child/student profiles, progress, and rewards you created, subject to the retention rules in the Privacy Policy. Deleting your account does not automatically cancel an app-store subscription — also cancel it in your Apple App Store or Google Play settings. We may suspend or terminate access if these Terms are breached, to protect users (especially children) or the Service, or if we discontinue the Service; where reasonable and lawful, we will give notice. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) survive.
Changes to these Terms
We may update these Terms from time to time. When changes are material, we will update the “last updated” date and, where appropriate, notify account holders. Continued use after changes take effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Australia, without limiting any mandatory consumer rights or protections that apply in your location.
